TheEnergy Regulatory Board has given the Manila Electric Co . up to March 18 to submit sales data and a new rate schedule pertinent to a power rate cut and a refund order.

"Today's refund order demonstrates the commission's commitment to ensure appropriate and reasonable prices in the wholesale electricity market given the supply and demand imbalance in California, " said Curt L . Hebert, the commission chairman.

He said the " overcharging " of the Panay electric utility was identical to thecase of the Manila Electric Co . ( Meralco ) which is already the subject of a refund order by the ERB.

William L . Massey, a Democrat, opposed the measure and issued a strongly worded dissent, calling the measure " arbitrary, capricious and an abuse of discretion " because it sharply restricted the scope of the agency's refund order.

ECN requested that an audit be conducted accordingly so that a refund order to all customers from 1990 up to the present be made subsequently ordering PECO to desist from including in its generation charges the items which are not directly related to the cost of generation,
