The Award of the Tribunal can be challenged directly in the Supreme Court under Article 136 of the Constitution of India as under that Article the Supreme Court is vested with the power and discretion to entertain appeals against the orders of any Court or Tribunal by granting special leave . अधिकरण के अधिनिर्णय को भारत के संविधान के अनुच्छेद 136 के अधीन सीधे उच्चतम न्यायालय में चुनौती दी जा सकती है क़्योंकि उस अनुच्छेद में उच्चतम न्यायालय को यह शक्ति प्रदान की गई है कि वह अपने विवेकानुसार विशेष इजाजत देकर किसी भी न्यायालय या अधिकरण के आदेशों के विरुद्ध अपील ग्रहण कर सकता है .

The Claims Tribunal , after giving notice of the application to the insurer and other necessary parties and after holding enquiry into the claim and giving the parties an opportunity of being heard , will make the award determining the amount of compensation which appears to the Tribunal just and proper and will also specify the person/persons who will have to pay the compensation . दावा अधिकरण बीमाकर्ता और अन्य आवश्यक पक्षों को नोटिस जारी करके और दावे की जांच करके तथा संबंधित पक्षवारों को सुनवाई का अवसर प्रदान करने के उपरांत प्रतिकर की जो राशि न्यायसम्मत और उपयुक़्त समझेगा , उसका अवधारण करते हुए अधिनिर्णय देगा जिसमें यह भी विनिर्दिष्ट किया जाएगा कि प्रतिकर की राशि कौन व्यक्ति देगा .
