An independent and supreme judiciary is also an essential requisite of a federal polity , wherein there is a constitutional division of powers between the federal government and governments of the constituent units and a functional division of powers between the executive , legislature and judiciary . संघात्मक राज्य व्यवस्था में स्वाधीन तथा सर्वोच्च न्यायपालिका एक अनिवार्य अपेक्षा है विशेषकर संघात्मक सरकार तथा उसके संघटक एककों की सरकारों के बीच संवैधानिक विभाजन है , और कार्यपालिका , विधायिका और न्यायपालिका के बीच शक्तियों का कार्यात्मक विभाजन है .
