Regarding the applicability of the principles of International Law in the circumstances of the case , the Crown contended that International Law as such had no binding force before the Tribunal which was dealing with the matter and that the Tribunal could take cognisance only of the rule of domestic or municipal law where , as the defence contended , the law of nations had as binding a force as statute or any other law . इस मुकदमे की परिस्थितियों में अंतर्राष्ट्रीय कानून के नियमों को लागू करने के प्रश्न से संबंध में साम्राज़्य की तरफ से कहा गया की अंतर्राष्ट्रीय कानून इस ट्रिब्यूनल के लिए बाध्यकारी न था और ऐसा ट्रिब्यूनल सिर्फ म्युनिसिपल और आंतरिक कानून के नियमों को ही मान्यता दे सकता था , जबकि बचाव पक्ष की दलील के अनुसार ' ला आफ नेशंस ' एक अधिनियम के तौर पर उतनी ही बाध्यकारी शक़्ति थी , जितना कि अन्य कोई कानून .

” That you being the editor of the paper young India on or about 29th day of September , 1921 , the 15th day of December , 1921 and the 23rd day of February , 1922 at Ahmedabad did write the words contained in the appendix to this charge and by these written words did bring or attempt to bring into hatred or contempt or did excite or did attempt to excite disaffection towards His Majesty or the government established by law in British India and thereby committed offences punishable under Section 124-A of the Indian Penal Code and within the cognisance of the Court of Sessions . ” कि तुमने ' यंग इंZडिया ' के संपादक होते हुए , 29 सितंबर 1921 , 15 दिसंबर 1921 और 23 फरवरी 1922 को अहमदाबाद में , इस अभियोग के परिशिष्ट में दिये गये शब्दों को लिखा और इन लिखित शब्दों द्वारा महामहिम सम्राट या ब्रिटिश भारत में कानूनतः स्थापित सरकार के खिलाफ घृणा और तिरस्कार की भावना जगाई या जगाने का प्रयास किया और राजद्रोह भड़काया या भड़काने का प्रयास किया.भारतीय दंड संहिता की धारा 124-ए के अंतर्गत और सेशन कोर्ट के न्यायाधिकार के भीतर दंडनीय अपराध किया .

The Sessions Judge charged them as follows : ” That you , Mohandas Karamchand Gandhi , being the editor of the paper Young India , on or about the 29th day of September , 1921 , the 15th day of December , 1921 and the 23rd day of February , 1922 at Ahmedabad did write the words contained in the appendix to this charge and by these written words did bring or attempt to bring into hatred or contempt or did excite or did attempt to excite disaffection towards His Majesty or the government established by law in British India and you , Shankerlal Ghelabhai Banker , being the printer of the paper Young India , on or about the 29th day of September , 1921 , the 15th day of December , 1921 and the 23rd day of February , 1922 at Ahmedabad did print the words contained in the appendix to this charge and by these written words did bring or attempt to bring into hatred or contempt or did excite or attempted to excite disaffection towards His Majesty or the government established by law in British India and thereby you committed offence punishable under Section 124-A of the Indian Penal Code and within the cognisance of thi सेशन जज ने उन पर ये आरोप लगाये : “ कि , मोहनदास करमचंद गांधी , तुमने ' यंग इंडिया ' के संपादक होते हुए , 29 सितंबर 1921 , 15 सितंबर 1921 और 23 फरवरी 1922 को , अहमदाबाद में , इस अभियोग के परिशिष्ट में दिये गये शब्दों को लिखा और इन लिखित शब्दों द्वारा महामहिम सम्राट या ब्रिटिश भारत में कानूनतः स्थापित सरकार के खिलाफ घृणा और तिरस्कार की भावना जगाई या जगाने का प्रयास किया और राजद्रोह भड़काया या भड़काने का प्रयास किया.शंकरलाल घेलाभाई बैंकर , तुमने ' यंग इंडिया ' के प्रकाशक होते हुए , 29 सितंबर 1921 , 15 सितंबर 1921 और 23 फरवरी 1922 को , अहमदाबाद में इस अभियोग के परिशिष्ट में दिये गये शब्दों को प्रकाशित किया और इन लिखित शब्दों द्वारा महामहिम सम्राट या ब्रिटिश भारत में कानूनतः स्थापित सरकार के खिलाफ घृणा और तिरस्कार की भावना जगाई या जगाने का प्रयास किया और राजद्रोह भड़काया या भड़काने का प्रयास किया.इस तरह तुम दोनों ने भारतीय दंड संहिता की धारा 124-ए के अंतर्गत और इस अदालत के न्यायाधिकार के भीतर दंडनीय अपराध किया . ”
