In criminal cases , an appeal to the Supreme Court shall lie if the High Court -LRB- a -RRB- has reversed an order of acquittal of an accused person and sentenced him to death , or -LRB- b -RRB- has withdrawn for trial before itself any case from any court subordinate to its authority and has in such trial convicted the accused person and sentenced him to death -LRB- article 134 ; Ram Kumar v . State of M.P . , AIR 1975 SC 1026 ; Padda Narayana v . State of U.P . , AIR 1975 SC 1252 -RRB- . फौजदारी मामलों में अपील उच्चतम न्यायालय में हो सकेगी , यदि ( क ) उच्च न्यायालय ने किसी अभियुक्त की दोषमुक्ति के आदेश को उलट दिया है और उसको मृत्युदंड का आदेश दे दिया है , या ( ख ) अपने अधिकार के अधीन किसी न्यायालय से किसी मामले को विचारण के लिए अपने पास मंगा लिया है और ऐसे विचारण में अभियुक्त को सिद्धदोष ठहराया है और उसे मृत्युदंड का आदेश दे दिया है ( अनुच्छेद 134 ; रामकुमार बनाम मध्य प्रदेश राज्य , ए आई आर 1975 एस सी 1026 ; पड्डा नारायण बनाम उत्तर प्रदेश राज्य , ए आई आर 1975 एस सी 1252 ) .
