Bhanudas -LRB- AIR 1977 SC 1027 -RRB- again , the Court held that all rights of personal liberty under articles 19 , 21 and 22 could be suspended during national emergency due to Presidential Orders under article 359 . भारत संघ बनाम भानुदास ( ए आई आर 1977 एस सी 1027 ) में पुन : न्यायालय ने निर्णय दिया कि अनुच्छेद 359 के अधीन राष्ट्रपति के आदेशों के कारण राष्ट्रीय आपात के दौरान अनुच्छेद 19 , 21 और 22 के अधीन व्यक्तिगत आजादी के सभी अधिकारों का निलंबन किया जा सकता है .

For example , during a proclamation of Emergency -LRB- a -RRB- the right to move court for enforcement of any of the fundamental rights except articles 20 and 21 can be suspended under article 359 and -LRB- b -RRB- executive and legislative power of the State shall not stand restricted under article 358 by the rights to freedom enshrined in article 19 . यथा , ( क ) आपात स्थिति की उदघोषणा के दौरान , अनुच्छेद 20 तथा 21 के सिवाय , किसी भी मूल अधिकार को लागू कराने के लिए न्यायालय में जाने के अधिकार को अनुच्छेद 359 के अधीन निलंबित किया जा सकता है और ( ख ) अनुच्छेद 358 के अधीन राज्य की कार्यपालक तथा विधायी शक्ति अनुच्छेद 19 में समाविष्ट स्वतंत्रता के अधिकारों द्वारा निलंबित नहीं हो जाएगी .

Article 353 read with article 365 provides that once Emergency is proclaimed , the executive power of the Union extends to giving of directions to any State in regard to the exercise of the executive powers of the State and failure to comply with the directions would constitute enough justification for imposition of President 's rule under article 356 . अनुच्छेद 365 के साथ पठित अनुच्छेद 353 का उपबंध है कि एक बार जब आपात की उदघोषणा कर दी जाती है तो संघ की कार्यपालिर्काशि> का विस्तार राज्य की कार्यपालिर्काशि>यों के प्रयोग के संबंध में किसी राज्य को निदेश दिए जाने पर हो जाता है और निदेशों का पालन करने में असफलता को अनुच्छेद 356 के अधीन राष्ट्रपति का शासन लागू किए जाने के लिए पर्याप्त औचित्य माना जाएगा .

Although any power exercised by the Parliament in the national interest or during an Emergency does not restrict the normal legislative power of a State Legislature , in case of any conflict the law made by the Parliament prevails and so long as it remains in force , the State Law , to the extent of its repugnancy , remains inoperative . यद्यपि संसद द्वारा राष्ट्रीय हित में या आपात Zस्थिति के दौरान प्रयोग की गई किसी शक़्ति से किसी राज़्य के विधानमंडल की सामान्य विधायी शक़्ति प्रतिबंधित नहीं होतीं , तथापि टकराव की स्थिति में संसद द्वारा बनाया गया विधान प्रवर्तन में रहता है और जब तक वह प्रवर्तन में रहता है तब तक राज़्य विधान , जहां तक संसद के विधान से उसके टकराव का संबंध है , अप्रवर्तनीय रहता है .

Under articles 356 and 357 , on the ground of failure of constitutional machinery in any State , all its executive and legislative powers may be taken over by the Union and under articles 352 to 354 , the Constitution can be converted into an entirely unitary one inasmuch as during Proclamation of Emergency , the executive and legislative powers of the Union extend to matters even in the State List . अनुच्छेद 356 तथा 357 के अधीन , किसी राज्य में संवैधानिक तंत्र की विफलता के आधार पर , उसकी सभी कार्यपालक तथा विधायी शक्तियों को संघ अपने हाथ में ले सकता है और अनुच्छेद 352 से 354 के अधीन , संविधान को पूर्णरूपेण एकात्मक रूप दिया जा सकता है क्योंकि आपात स्थिति की उद्घोषणा के दौरान , संघ की कार्यपालक तथा विधायी शक्तियां राज्य सूची में सम्मिलति विषयों पर भी लागू हो जाती हैं .
