But , on the insistence of friends and relations , he agreed to have a legal adviser to watch the procedings of the Tribunal and to give him advice on lines of cross-examination . लेकिन दोस्तों और संबंधियों के आग्रह पर उन्होंने ट्रिब्यूनल की कार्यवाही पर नजर रखने और जिरह के लिए उन्हें परामर्श देने के लिए एक कानूनी परामर्शदाता का सहयोग लेना स्वीकार कर लिया .

The Chief Justice of the High Court would constitute a Tribunal for the trial of the said cases consisting of three persons who at the time of such constitution were judges , additional judges or officiating judges of the High Court . उक़्त मुकदमों के लिए उच्च न्यायालय के मुख़्य न्यायाधीश ऐसे तीन व्यक़्तियों को लेकर ट्रिब्यूनल का निर्माण करेंगे , जो उस वक़्त उच्च न्यायालय के सहायक या प्रभारी न्यायाधीश हों .

“ Hence , ” he said , “ the only law which applied to such a conspiracy case was the ' Law of Nations ' and a municipal tribunal as the district court of Meerut had no true jurisdiction over the case . ” उन्होंने कहा “ अतः , ऐसे षड्यंत्र कांड मुकदमे में सिर्फ एक ही कानून लागू होता है , ' ला आफ नेशन्स ' का कानून और मेरठ के जिला न्यायालय जैसे म्युनिसिपल ट्रिब्यूनल को ऐसा मुकदमा चलाने का कोई अधिकार नहीं हैं . ”

In very rare circumstances , if we think that either you or the LEA have acted unreasonably or deliberately wasted our time , the LEA may have to pay your costs , or you may have to pay theirs . बहुत ही कम ऐसा होता है कि यदि ट्रिब्यूनल यह समझे कि आप ने या एल ई ए तर्कसंगत व्यवहार नहीं किया है , या जानबूझकर ट्रिब्यूनल का समय बरबाद किया है , तो एल ई ए को आफ के ख़र्चों का , या आप को एल ई ए के ख़र्चों का भुगतान करना पड़े .

It provided that all cases pending in the court of Rai Sahib Pandit Sri Kishan , first-class magistrate , Lahore against any or all the persons -LRB- 24 in number -RRB- would be tried by the Tribunal to be constituted under Section 4 . इसमें कहा गया कि लाहौर में प्रथम श्रेणी मजिस्ट्रेट राय साहेब पंडित श्री कृष्ण की अदालत में 24 व्यक़्तियों के खिलाफ चल रहे सभी विचाराधीन मुकदमों को धारा 4 अंतर्गत निर्मित ट्रिब्यूनल द्वारा चलाया जायेगा .

When the court resumed hearing on 26th September , it was argued before the Tribunal that they should stay the proceedings and allow Savarkar ' s- petition against his arrest at Marseilles on the French soil to go to the French and British Governments . 26 सितंबर को अदालत जब दोबारा लगी तो ट्रिब्यूनल के सामने यह बहस की गयी कि इस मुकदमे को स्थगित कर दिया जाए और मर्साई में गिरफ्तारी के खिलाफ सावरकर की याचिका फ्रांसिसी और ब्रिटिश सरकारों को भेज दी जाये .

The Government of India , afraid of trying Savarkar before a regular court of law , appointed a Special Tribunal under the special Act to try the case without a jury , denying him the right of apppeal . भारत सरकार ने विधिवत अदालत में सावरकर पर मुकदमा चलाने से डर कर एक विशेष अध्यादेश के अंतर्गत एक विशेष ट्रिब्यूनल की स्थापना की जिससे कि मुकदमा बिना किसी जूरी के चलाया जा सके और अभियुक्त को अपील करने का अधिकार तक न दिया जाये .
