At the outset of the appeal, on Oct 20 Appeals Court judges Datuk Gopal Sri Ram, Datuk Abdul Malek Ahmad and Datuk Ahmad Fairuz Sheikh Abdul Halim, dismissed Juraimi's application to adduce evidence on the conduct of the trial judge.

It is, thus, for that employer to adduce evidence that it has not breached the principle of equal treatment, which it can do, inter alia, by showing that the actual recruitment practice of the undertaking does not correspond to those statements.

"It may be advisable for a lawyer representing Mr . El-Gabrowny's interest to make arguments distancing Mr . El-Gabrowny from one or all of those defendants, or to adduce evidence helpful to Mr . El-Gabrowny but harmful to one or all of those defendants,"

Another Supreme Court success came in R v Wi [ 2010 ] 2 NZLR 11, 24 CRNZ 731, which reversed several lower court decisions and held that adducing evidence of a lack of previous convictions was still admissible under the Evidence Act 2006 ."

After the claimant has adduced evidence of the objective value of the benefit which the defendant received, the burden of proof falls upon the defendant to prove that he did not subjectively value the benefit at all, or that he valued it at less than the market price . ..

There was a further bitterly contested election in 1774 : allegations of bribery were investigated by a House of Commons committee, whose proceedings are recounted at length by the contemporary historian of electoral abuses, Thomas Oldfield . counsel for Praed and Drummond adduced evidence that Stephens had also resorted to bribery.

The Court of First Instance therefore rightly held, despite faulty legal reasoning, that, since the Commission had established to the requisite legal standard that Anic had participated in collusion for the purpose of restricting competition, it did not have to adduce evidence that the collusion had manifested itself in conduct on the market.
