Ii that while a judicial authority ought to be thoroughly impartial , and ought to approach the consideration of any case without previous knowledge of the facts , an executive officer does not adequately discharge his duties unless his ears are open to all reports and information which he can in any degree employ for the benefit of the district ; जहां न्यायिक प्राधिकारी को पूर्णतया निष्पक्ष होना चाहिए और उसे किसी मामले पर विचार आरंभ करते समय तथ्यों का पूर्वज्ञान नहीं होना चाहिए , वहां कार्यपालक अधिकारी तब तक अपने कर्तव्यों का समुचित ढंग से निर्वाह नहीं कर सकता जब तक कि वह उन सभी सूचनाओं और जानकारियों को कान न दे जिन्हें वह जिले के हित के लिए काम में ला सकता है ;

The king would appoint as members of the court of justice honourable men whose integrity had been tested and tried and who were able to bear the burden of the administration of justice ; they were also expected to be well versed in the sacred laws as well as the rules of jurisprudence and were noble and impartial towards friends or foes . न्यायाधीश और उनकी योग्यताएं सम्राट ऐसे सम्माननीय व्यक्तियों को न्यायालय के सदस्य नियुक्त करता था जिनकी ईमानदारी जांची परखी जा चुकी हो और जो न्याय के प्रशासन का भार उठा सकने में समर्थ हों.इनसे यह भी आशा की जाती थी कि वे धर्मशास्त्र और साथ ही , विधिशास्त्र के नियमों के ज्ञाता होंगे , कुलीन होंगे तथा मित्रों और शत्रुओं के प्रति समभाव रखने वाले होंगे .

“ That the circumstances of British India are such , that this hon ' ble court and the other High Courts in the other presidencies are looked upon , and I believe justly looked upon , as the staunchest , the most upright and the most impartial upholders of the just rights and privileges of all sections of the community , and any action on the part of any hon ' ble and learned judge of these hon ' ble courts tending to show the least disregard of such rights and privileges is viewed with great alarm by the community , and I conceive that it is the duty of all journalists to maintain that no such disregard is shown . ” “ ब्रिटिश भारत की जो परिस्थितियां हैं , उनमें इस माननीय अदालत और दूसरी प्रेसिडेंसियों के उच्च न्यायालयों को बड़े आदर के साथ देखा जाता है और मेरा मानना है कि समाज के सभी वर्गों के न्यायोचित अधिकारों और विशेषाधिकारों के सर्वाधिक निष्पक्ष , सच्चे और ईमानदार संरक्षकों के रूप में उन्हें इतना आदर देना उचित भी है.इस माननीय अदालत का कोई विद्वान , माननीय न्यायाधीश अगर इन अधिकारों और विशेषाधिकारों का आदर करता है तो उसके आचरण को समाज द्वारा बड़ी चिंता के साथ देखा जाता है और मैं समझता हूं कि सभी पत्रकारों का यह दायित्व है कि वे ऐसा अनादर न होने दें . ”

According to the ruling of The supreme court, article 324(1) the power of the election commission does not vest with Chief Election commissioner but it has powers only in those constitutional matters relating to fair, impartial and just election process, it has the powers to organize supervise and conduct elections and it has right over those area where there are no ther conflicting laws enacted by the parliament, to ensure free, fair and impartial elections the elections commission has unlimited powers,if the principle of Natural justices and the laws enacted by the parliament have to be used for the common good of all. 2.सुप्रीम कोर्ट के निर्णयानुसार अनु 324[1] मे निर्वाचन आयोग की शक्तियाँ कार्यपालिका द्वारा नियंत्रित नहीं हो सकती उसकी शक्तियां केवल उन निर्वाचन संबंधी संवैधानिक उपायों तथा संसद निर्मित निर्वाचन विधि से नियंत्रित होती है निर्वाचन का पर्यवेक्षण निर्देशन नियंत्रण तथा आयोजन करवाने की शक्ति मे देश मे मुक्त तथा निष्पक्ष चुनाव आयोजित करवाना भी निहित है जहां कही संसद विधि निर्वाचन के संबंध मे मौन है वहां निष्पक्ष चुनाव करवाने के लिये निर्वाचन आयोग असीमित शक्ति रखता है यधपि प्राकृतिक न्याय विधि का शासन तथा उसके द्वारा शक्ति का सदुपयोग होना चाहिए
