Barnes has said he had a legitimate business deal with Smith for nonlottery consulting, although prosecutors said they couldn't find any evidence that Smith did anything for the money and noted that the payments stopped when a New Jersey grand jury started issuing subpoenas in the Smith case in December 1993.
