After the evidence in the case has been recorded and arguments heard , the Sessions Judge addresses the accused . मामले के साक्ष्य अभिलेखबद्ध हो जाने और बहस सुन लेने के बाद सत्र न्यायाधीश अभियुक्त को संबोधित करता है .

“ 1 find both the accused guilty of both the offences with which they are charged and convict them accordingly . ” “ मैं दोनों अभियुक़्तों को लगाये गये दोनों अभियोगों के लिए वास्तविक अपराधी मानता हूं और दंड देता हूं . ”

The whole point of asking for the deposit is to make sure that the accused does not run away before his trial . धनराशि जमा करने को कहने का एक ? मात्र उद्देश्य यह सुनिश्चित करना है कि अभियुक़्त मुकदमें से पहले भाग न जाये .

To this end each of the accused delivered an individual statement of defence followed by joint statement . इस उद्देश्य की प्राप्ति के लिए प्रत्येक अभियुक़्त ने संयुक़्त वक़्तव्य से पहले अपनी व्यक़्तिगत सफाई भी पेश की .

The Advocate General then made an application and withdrew the fourth charge against the accused under Section 333 . इसके बाद एडवोकेट जनरल ने एक याचिका द्वारा अभियुक्त के खिलाफ धारा 333 के तहत लगाए गये चौथे अभियोग को वापिस ले लिया .

The trial started on 19th October , 1908 before the Additional Sessions Judge who charged the accused as follows : 19 अक्तूबर 1908 को अतिरिक्त सेशन न्यायाधीश के सम्मुख मुकदमा शुरू हुआ , जिन्होंने अभियुक्तों पर निम्नलिखित अभियोग लगाये :

After raising revolutionary slogans and throwing leaflets in the Central Hall , both the accused courted arrest at the hands of the police . केंद्रीय कक्ष में पर्चे फेंकने और क्रांतिकारी नारे लगाने के बाद दोनों अभियुक़्त पुलिस के हाथों गिरफ्तार हुए .

Comintern and the correspondence between the accused and Roy were cited as proof of the conspiracy . कमिन्टर्न के प्रस्ताव व अन्य घोषणाएं तथा अभियुक़्तों व राय के बीच हुआ पत्र व्यवहार षड्यंत्र के प्रमाण रूप में प्रस्तुत किए गए .

The mischief of conviction is greater than even the mischief caused by the alleged speeches or rather by the arrest of the accused . अभियुक़्त के भाषणों से या उसकी गिरफ्तारी से जितना नुकसान हुआ है , उसे दंडित किये जाने पर उससे भी ज़्यादा नुकसान होगा .

The accused are young men but their acts were deliberate and they had made preparations for those acts of a complicated nature . अभियुकऋ-ऊण्श्छ्ष्-त युवक हैं , लेकिन उनऋ-ऊण्श्छ्ष्-होंने सोर्चसमझकर ये काम किये और इन पेचीदा कामों के लिए काफी तैयारी की .
